Terms of Use
These Terms of Use apply to your participation in Huggity FanPic , which enables you to tag yourself and your Facebook friends in a huge photograph of the crowd taken at various events.
By browsing the Huggity website and/or by submitting your email address and Facebook password to log on to Huggity App in order to start tagging you acknowledge and agree that you have read and accept these Huggity FANPIC™ Terms of Use and that you consent to Huggity using your photograph as explained below.
If you do not agree to these Huggity FanPic™ Terms of Use please do not use or browse Huggity website and Photo.

What Huggity FanPic is and how it works
Huggity Application will allow you to tag yourself after taking a highly detailed picture of crowds (FanPic™) at various events. We will take several hundreds of photographs of all the people gathered at an event at the time which will be announced ahead of the event. We will put these photographs together to create one huge photograph – Huggity FanPic GigaPixel Photo, a 360 degree multibillion pixel image (the ‘photo or FanPic’). We will then upload the photo to a website which will be announced during the event and make it available for viewing online, and make possible tagging and sharing by people with a Facebook account.
Tagging Conditions
You can tag yourself and your Facebook friends on our photo. To do that you must either be 18 years of age or have appropriate consent from your parent or guardian. By submitting your email address and Facebook password to log on in order to start tagging yourself and/or your Facebook friends on the Huggity website represent and warrant to Huggity and that:
you are over 18 years of age at a time of the event when photograph is taking place; or
you are under 18 years of age at a time of the event when photograph is taking place and your parent or guardian has read and accepted on your behalf these Huggity Terms of Use; and agrees to your participation in the Photo, use of your image and Tagging Photo Online as explained below.
How we will use the photographs
After we have taken the photographs, we will put them together to create one huge photograph of the crowds. We will then upload the photo on Huggity.com or one of pur partners website which will be announced during the event and make it available on a date announced during the event for 12 months for people with a Facebook account to tag themselves and their Facebook friends using the Facebook Connect functionality. We may extend the period for which the photo will be available for tagging and if we do this we will post an announcement on the Huggity website
Who you can tag and how
You will only be able to log on and get tagging if you have a Facebook account. You can only tag yourself and your Facebook friends. You must only tag your Facebook friends if you have previously told them that you want to tag them and they have agreed. As a Facebook user you have already accepted Facebook’s terms, which apply to your use of your Facebook account and require you to only tag people if you have their previous consent. By tagging your Facebook friends on Huggity sites you represent and warrant to Huggity: you will not attempt to tag people who are not your Facebook friends; you will not tag your Facebook friends without having previously confirmed with them that they agree to be tagged; you will ensure that you are tagging people correctly and you will not knowingly tag someone who is not the person to whom the tag relates; and your tagging is in all respects in accordance with these Huggity Terms of Use and the Facebook Terms which apply to your use of your Facebook account.
Who can tag you and how you will know that you’ve been tagged
You can only be tagged if you have a Facebook account and only by your Facebook friends. When you are tagged you will receive a notification from Facebook that your Facebook Friend has tagged you, however this also depends on your personal Facebook privacy settings. You will be able to follow the link in that message to check the tagging and remove it if you do not wish to be tagged.
How you can remove or un-tag yourself
We require those who tag their Facebook friends to obtain their prior consent to do so. If you think that you have been tagged without your consent, simply wish the tag identifying you in the photo to be removed or you want us to remove your face from a photo, you can always send an email to tags@huggity.com and we will advice you how to do it.
You can also use special form within the FanPic interface – "Remove Me" button to do that.
You might be asked to provide us with your exact location in the Photograph and email address and you will be removed (by the blurring or covering of your face) within 5 working days of receipt of your e-mail.
Liability
Huggity Ltd shall not be liable for any failure to comply with their obligations where the failure is caused by something outside their reasonable control. Such circumstances shall include, but not be limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, supervening legislation or any other circumstances amounting to force majeure.
Huggity Ltd accept no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by you as a result of the Photograph. Nothing in these terms and conditions shall exclude the liability of the Huggity Ltd for death or personal injury as a result of its negligence or for fraud or fraudulent misrepresentation.
This promotion is neither promoted; endorsed; administered by or associated with Facebook, and each entrant hereby releases Facebook from any liability there under, and that any information provided by the entrant is provided only to the Promoter and not for the benefit of Facebook.
These Terms of Use shall be governed by Republic of Ireland law and the Irish courts shall have exclusive jurisdiction.
